TENANCY AGREEMENT

THIS TENANCY AGREEMENT is made this _________ day of ___________, 2023

BETWEEN

MSUAAN MICHAEL of No. 37 Tunga Street, U/Romi, Kaduna (hereinafter called “the Landlord” which expression shall where the context so admits include his heirs, successors-in-title, legal representatives and assigns) of the one part.

 AND

GODWIN YOHANNA ABRAK of No. 21, Eurofoam Street, Ungwan Maigero, Kaduna, (hereinafter referred to as “theTenant” which expression shall where the context so admits include his heirs, successors-in-title and legal representatives) of the other part.

  1. WHEREAS:
  1. The Landlordis the lawful owner of the newly finished to taste three (3) Bedroom Bungalow together with all the appurtenances as well as the fittings and fixtures attached thereto (referred to as the “Apartment Inventory”), lying and situate along Maidawa Street, Janruwa, Chikiun LGA, Kaduna State (hereinafter called “the Apartment”).
  • The Landlord is desirous of letting out the apartment in its tasteful, sound and habitable condition and the Tenant has anxiously agreed to take the apartment as “the First-To-Inhabit” upon the terms and conditions hereunder appearing.
  • NOW THIS AGREEMENT WITNESSETH AS FOLLOWS:

In consideration of the rent hereinunder reserved, the Landlord do hereby let unto the Tenant, the apartment for a term of Two (2) Years commencing from the __________ day of ____________, 2023 to the ________ day of ______, 2025, subject to the Tenant’s Covenants hereunder appearing.

  • THE TENANT HEREBY COVENANTS WITH THE LANDLORD AS FOLLOWS:
  1. To pay the rent herein reserved in the sum of ₦2,000,000.00 (Two Million, Naira only) in two equal instalments, to wit: N1,000,000.00 on or before execution of this agreement and the balance of N1,000,000.00 to be paid within 90 (ninety) days from the date of the first payment.
  • In subsequent terms (if granted), must be paid in advance and not later than twenty-one (21) days after the expiration of the last rent paid, whether same is demanded or not.
  • Not to alter the structure of the Apartment or any part thereof without a written consent of the Landlord.
  • Not to sublet any part of the Apartment or transfer possession of the Apartment to anyone without a written consent of the Landlord first had and obtained.
  • To keep the Apartment and its immediate surroundings in a good, habitable  and hygienic conditions and free from any damage caused to all or any part thereof by the Tenant.
  • To pay promptly, all charges of electricity, sanitation and water bills as at when due and payable in respect of the Apartment. The Tenant shall be liable for any breaches relating to the use of electricity, water, etc directly or indirectly traceable to the Tenant. 
  • To clean and maintain good sanitary conditions of the property and its surroundings including regular evacuation of the Septic tank/Soak away; and to comply strictly with the environmental laws and Government regulations at all material times.
  • Not to constitute nuisance or security threat to the occupiers of the adjourning premises and shall be personally liable for any nuisance, public disturbance or security breach emanating from or traceable to the Apartment.
  1. To allow the Landlord, Property Manager, agent or workmen whenever expedient and particularly during business hours precisely 8.00am – 5.00pm to enter and inspect the Apartment.
  • To deliver up peaceful possession of the apartment to the Landlord or legal representative not later than seven (7) days after the expiration of the term herein expressly granted or subsequently renewed.
  • THE LANDLORD COVENANTSWITH THE TENANT AS FOLLOWS:
  1. To allow the tenant performing and observing the covenants hereinbefore contained, to quietly hold and enjoy the Apartment during the term granted without any unlawful interruption by the Landlord or any person claiming through or in trust for the Landlord.
  • To keep the Apartment in good structural condition and repairs except where the structurer damage is traceable to the Tenant.
  • IT IS MUTUALLY AGREED BY THE PARTIES AS FOLLOWS:
  1. The Tenant is at liberty to use the Apartment either for residential purpose or as a health facility (i.e Hospital/Clinic/Pharmacy).
  • The tenancy can be terminated and or determined by either party by giving one month notice in writing to the other party during the subsistence of the tenancy. However, where the tenancy is due for twenty-one (21) days, or the Tenant is in breach of ANY of the covenants hereinbefore contained, the Tenant shall be deemed a Tenant-At-Will and shall be entitled to One Week Notice of Owner’s Intention to Recover Premises.
  • At a request by the Tenant made 2 (two) months before the expiration of the term herein granted, the Landlord may let the Apartment for a further term of year(s) under the same or different conditions as may be mutually further agreed upon by the parties.
  • The Landlord reserves the right to upwardly review the rent payable, provided that two months notice of the intended increment is served on the Tenant before the expiration of the current term.
  • The Apartment Inventory forms part of this Agreements. Consequently, it is mutually agreed that any broken, missing or damaged item in the Apartment Inventory shall be replaced by the Tenant before peaceful delivery of possession or forceful eviction.
  • Service of Notice to Quit, Notice of Owner’s Intention to Recover Premises and other documents/correspondences including court processes shall be deemed sufficiently and properly served if delivered to or left with any occupant of the Apartment, or pasted on the gate or the main entrance to the Apartment. Acknowledgement is not a requirement within the context of this Agreement.
