APPEAL – INTERFERENCE WITH CONCURRENT FINDING(S) OF FACT(S) – Instances where the Supreme Court will not interfere with concurrent findings of fact(s) made by Lower Courts

Uncategorised

“The question that naturally follows in this Court in the light of the concurrent findings of the two Courts below is if this Court can interfere with those findings when there is no miscarriage of justice. I would answer in the negative, see Igago V State (1999) 12 SCNJ 140 and Nkebisi V state (2010) All FWLR (p 521) 1407.” Per PETER-ODILI, J.S.C. in BERENDE v. FRN (2021-LCER-40453-SC) (Pp 43 – 43 Paras D – F)
