It was held in Egbe Vs Adefarasin (supra) that, in order to determine the period of limitation, the court will look at the Writ of Summons and Statement of Claim (or in this case the appellant’s counter claim) alleging when the wrong was committed. If the time on the writ is beyond the period allowed by the limitation law, the action is statute barred.
