“By Section 4(1) and (2) and Section 18(3) of the Local Government Law, Cap 109 of 2004, as amended by Section 2 of the Local Government Area (Amendment No.5) Laws of Enugu State, 2010, the tenure of office of a Local Government Council Chairman is two years commencing from the date of the first sitting of the council. Nigeria is a Country governed by the rule of law. No tenure can be extended beyond the period stipulated at the whims and caprices of the Governor, without an amendment to the existing law.” Per KEKERE-EKUN, JSC in APC & ORS v.
