EVIDENCE – CONFESSIONAL STATEMENT – When Court can rely on a confessional statement:

“Indeed, Section 29 of the Evidence Act 2011 (as amended) which is the basis of the trial-within-trial, empowers the Court to admit and rely on confessional statements unless the statements were obtained by oppression or in consequence of anything said or done as to render any such confession unreliable.” Per PETER-ODILI, J.S.C. in BERENDE v. FRN (2021-LCER-40453-SC) (Pp 53 – 53 Paras B – D)
