CRIMINAL LAW AND PROCEDURE – SENTENCING – Whether Courts have discretion in sentencing where the law has made specific provisions for the sentence to be imposed

Uncategorised

“There is no discretion in sentencing where the law has made specific provisions for the sentence to be imposed, as in a capital offence. The only sentence pronounceable, where all the ingredients have been established, is death. See State vs Babangida John (2013) NSCQR 1903 @ 1939; Okpo vs The State (1972) 2 SC 24.” Per KEKERE-EKUN, JSC in AKPAKPAN v. STATE (2021-LCER-40459-SC) (Pp 39 – 39 Paras E – G)
