Considering and applying the principles (in Mohammed v. State) to the Appellant’s case, it is beyond argument that the non-compliance with the provisions of Section187 (1) of the Criminal Procedure Code (CPC) on the necessary steps to be taken in the proper arraignment of the Appellant before the trial High Court constituted an error in the procedure of his arraignment for the offences he was charged with before that court which did not occasion a miscarriage because the Appellant was represented by counsel at the time of the arraignment.Per MOHAMMED LAWAL GARBA, JSC in JEREMIAH JOSEPH V.
