CONSTITUTIONAL LAW – SUPREMACY OF THE CONSTITUTION – Effect of any Law or Act that is inconsistent with the Constitution

“While I recognize the Constitutional right of the Anambra State House of Assembly, donated under Section 4(6) and (7) (a) (b) and (c) of the Constitution, to make laws for the peace, order and good government of the State, the exercise of that power must be in line with the dictates of the Constitution. A law enacted in excess of the powers granted by the Constitution is void to the extent of the inconsistency with the provision of the Constitution.” Per JOHN INYANG OKORO, JSC In NWOKEDI v. ANAMBRA STATE GOVT & ANOR (2022-LCER-46521-SC) (Pp 39 – 39; Paras B – D)
